These terms govern your use of this website and your enrollment in any InCAD training program, service or event. Please read them before using our site or booking a program.

By accessing this website (www.incad.org) or enrolling in any program, service or event offered by InCAD — Institute for Capacity Development ("InCAD", "we", "us", "our"), you agree to be bound by these Terms of Service. If you do not agree with any part of these terms, please do not use this website or enroll in our programs.
These terms apply to all visitors, program participants, sponsoring organizations and anyone who otherwise interacts with our services.
Our Services
InCAD provides training and capacity development, research and surveys, study missions and conference tourism, study/work‑abroad guidance, performance contracting support, recruitment and HR consultancy, and entrepreneurship development programs, as described on our Services page.
Program dates, venues and content on this website — including the program calendar — are provided for planning purposes and may change. Where a change affects a program you've enrolled in, we will make reasonable efforts to notify you in advance.
Use of This Website
You agree to use this website only for lawful purposes and in a way that does not infringe the rights of, or restrict or inhibit the use and enjoyment of this site by, any third party. Prohibited behavior includes:
- Attempting to gain unauthorized access to any part of the website, servers, or databases connected to it.
- Uploading or transmitting viruses, malware, or any other malicious code.
- Scraping, copying, or republishing substantial parts of this website without our written permission.
- Impersonating InCAD, our staff, or any other person or organization.
Program Enrollment
Submitting an inquiry or enrollment request through this website (including the "Request a Consultation" and "Send an Inquiry" forms) does not guarantee a reserved place on a program until confirmed in writing by InCAD.
You are responsible for providing accurate contact and organizational details when enrolling. InCAD reserves the right to decline or defer enrollment where a program is fully subscribed or where the requested customization falls outside our current capacity.
Per our standing policy, organizations are welcome to request a change of programme date or venue to suit their schedule and location preference; such requests are accommodated where reasonably possible.
Fees & Payment
Program fees, where published (for example, our monthly online sessions at KSh 3,000 per session), are quoted in Kenya Shillings unless stated otherwise and are subject to change without notice for programs not yet booked. Fees for in‑house or customized programs are agreed individually and confirmed in a written proposal before delivery.
Payment terms, invoicing details and accepted payment methods will be communicated directly to your organization upon confirmation of a booking.
Cancellations & Rescheduling
InCAD may reschedule or relocate a program where circumstances require it (for example, low enrollment, venue unavailability, or events outside our control), and will notify confirmed participants as early as possible.
Cancellation terms for paid bookings — including any applicable refund or credit policy — will be set out in your program's specific enrollment confirmation or contract, since these can vary between open‑enrollment, regional and in‑house programs.
Participant Conduct
Participants in InCAD programs are expected to engage respectfully with facilitators and fellow participants, and to comply with the ethical standards described on our About & Ethics page. InCAD reserves the right to remove a participant from a program in cases of harassment, misconduct, or behavior that disrupts the learning environment, without refund of fees already paid.
Intellectual Property
All curriculum materials, training content, website text, graphics, logos and the InCAD name and mark are the property of InCAD or its licensors and are protected by applicable intellectual property laws. Materials provided during a training program are licensed to participants for their own personal or internal organizational use only, and may not be resold, republished, or used to deliver a competing training program without our written consent.
Limitation of Liability
InCAD provides its programs and this website on an "as is" and "as available" basis. To the fullest extent permitted by law, InCAD shall not be liable for any indirect, incidental, or consequential loss arising from your use of this website or participation in our programs, including loss of business, revenue, or data.
Nothing in these terms limits any liability that cannot be excluded or limited under applicable Kenyan law.
Privacy
Our collection and use of personal information in connection with this website and our programs is described in our Privacy Policy, which forms part of these Terms of Service.
Changes to These Terms
We may update these Terms of Service from time to time to reflect changes in our programs, legal requirements, or business practices. The "Last updated" date at the top of this page will reflect the most recent revision. Continued use of this website or enrollment in our programs after an update constitutes acceptance of the revised terms.
Governing Law
These Terms of Service are governed by and construed in accordance with the laws of the Republic of Kenya. Any disputes arising from these terms or your use of our services shall be subject to the exclusive jurisdiction of the courts of Kenya.
